ORDER

This writ petition is filed seeking to declare the action of the respondents in not considering the representations of the petitioner dated 6.7.2015 and 24.12.2015, which were filed for removal of his name from the suspect sheet and calling him to the police station without any crime, as arbitrary and illegal. The petitioner is working as Supervisor in "Imperial Granites Private Limited" situated at Madikonda, Hanamkonda Mandal, Warangal District, since 1999 and he has been leading the union activities. While so, a false case was registered against him by the Station House Officer, Madikonda Police Station, for the offence punishable under Section 379 IPC, in Cr.No.115 of 2013. With the influence of the company management, a suspect sheet was opened against the petitioner and subsequently, it was transferred to Kazipet Police Station for want of jurisdiction. After trial in C.C.No.284 of 2013, he was acquitted of the offence. In spite of acquittal and non-registration of any crime against the petitioner, when the suspect sheet was not closed, the present writ petition is filed.

A counter-affidavit is filed by the 4th respondent stating that the suspect sheet opened against the petitioner on 18.12.2013 was transferred to Kazipet Police Station on the point of jurisdiction. The petitioner and another involved in Cr.No.115 of 2013 were

arrested and remanded to judicial custody. However, the case ended in acquittal.

In view of acquittal of the petitioner in Cr.No.115 of 2013 and non-registration of any fresh crime, the continuance of suspect sheet is not warranted against him.

Accordingly, the Writ Petition is allowed. The respondents are directed to close the suspect sheet forthwith. However, this order will not prevent the respondents from taking any action, in accordance with law. No costs.
