THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.495 of 2016 ORDER:

This Criminal Petition is filed by the petitioner - accused No.2 under Section 482 Cr.P.C., seeking to modify the order, dated 12.01.2016, passed in Crl.MP No.3621 of 2015 in C. No.20/2015/R1 & 1 on the file of Special Judge for Economic Offences, Hyderabad. Heard and perused the material available on record. The petitioner is A2 in the above crime. He is alleged to have arranged A1 to smuggle gold chain weighing about 1230 grams, from Hyderabad to Visakhapatnam. He was arrested by the police on 15.12.2015. He filed bail application before the Court below and the Court below allowed the said application and directed the petitioner to execute a bond for Rs.2,00,000/- with two sureties for the like sum. Seeking to reduce the surety amount, the petitioner filed the present application.

The learned counsel for the petitioner informs that the petitioner belongs to a poor family and he is not in a position to arrange for such a huge amount and he was arrested on 15.12.2015 and since then he has been in judicial custody and hence, requested to reduce the surety amount.

Considering the facts and circumstances of the case, this Court is inclined to pass the following order.

The petitioner shall be enlarged on bail on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for the like sum each to the satisfaction of the Special Judge for Economic Offences, Hyderabad. The other conditions in the order of the Court below shall stand unaltered.
