THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17447 OF 2017 ORDER:

The Writ Petition is filed under Article 226 of the Constitution of India, to declare the action of the 3rd respondent in registering crime in COR No.32/ 2017 against the petitioner, as illegal and arbitrary and consequently, set aside the said crime insofar as the petitioner is concerned.

The petitioner is carrying on business in purchase and sale of jaggery both retail and wholesale under the name and style of M/ s.Jeevan Trading Company. On 21.04.2017 the 3rd respondent, along with his staff, came to the shop of the petitioner and by force taken away the workers and closed down the shutter and affixed seals to the shop and godown. The grievance of the petitioner is that on the confession of A1, the authorities have implicated the petitioner as accused No.4 in the above crime, which is registered for the offences under Sections 7 (A) r/ w.8 (e) of A.P. Prohibition Act and 34(e) of the A.P. Excise Act. Therefore, apprehending arrest in the above crime, the petitioner filed this writ petition.

Heard and perused the material available on record. Upon hearing the learned counsel for the petitioner and on perusing the material available on record, this Court is of the view that the present petition is premature in nature and therefore, this Court is not inclined to entertain the same.

Hence, the Writ Petition is dismissed. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand dismissed. ______________ RAJA ELANGO, J July 17, 2017 KTL
