Manem Venkata Ramanamurthy v. Manem Padmaja
HON'BLE SRI JUSTICE C. PRAVEEN KUMAR Crl.R.C.No.1425 of 2013
ORDER
The present revision is filed against an order dated 17.07.2013 passed in Crl.M.P.No.215 of 2012 in M.C.No.5 of 2012 on the file of the Judge, Family Court-cum-III Additional District and Sessions Judge, Srikakulam, wherein the said Court while disposing of the said Crl.M.P., awarded a sum of Rs.6,000/- and Rs.2,500/- per month towards interim maintenance to the first and second petitioners therein respectively, from the date of petition.
2. Though the present revision is filed questioning the said order, however, learned counsel for the petitioner seeks a direction to the Court below to dispose of M.C.No.5 of 2012 as expeditiously as possible. He further submits that the petitioner has been paying half of the amount awarded regularly and that as he is the sole bread winner of the family, it would be difficult for him to pay the entire amount awarded.
3. Having regard to the said circumstances, without going into the merits of the case, the Criminal Revision Case is disposed of, by advising the Judge, Family Court-cum-III Additional District and Sessions Judge, Srikakulam, to dispose of M.C.No.5 of 2012 as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order. However, in view of the agreed stand taken by both the learned counsel, the petitioner shall pay a sum of Rs.1,50,000/- (One lakh fifty thousand only) towards arrears of maintenance, within a period of
four weeks from today and he shall continue to pay the interim maintenance as he was paying earlier till disposal of M.C.No.5 of 2012. The amounts, if any, already paid by the petitioner shall be adjusted accordingly. Miscellaneous petitions, if any, pending in this revision shall stand closed.
