THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.1395 OF 2016 ORDER:

This Civil Revision Petition is filed under Article 227 of the Constitution of India challenging the order dated 23.12.2015 passed in I.A.No.1023 of 2015 in A.S.No.463 of 2015 on the file of the Court of the VIII Additional District and Sessions Judge, Ranga Reddy District at L.B. Nagar.

Head the learned counsel for both the parties. 3.

Admittedly, there is an interim injunction in favour of the respondent during pendency of the suit. After full-fledged trial, the suit was decreed by granting perpetual injunction in favour of the respondent against the petitioners. Feeling aggrieved by the judgment and decree dated 27.04.2015 in O.S.No.334 of 2011 on the file of the Court of the II Additional Junior Civil Judge, Ranga Reddy District at L.B. Nagar, the petitioners/defendants preferred A.S.No.463 of 2015 on the file of the Court of the VIII Additional District and Sessions Judge, Ranga Reddy District at L.B. Nagar. 4.

Learned counsel for the respondent, in all fairness, submitted that the respondent will not proceed with E.P.No.12 of 2015 in O.S.No.334 of 2011 on the file of the Court of the II Additional Junior Civil Judge, Ranga Reddy District, till disposal of the appeal.

In view of pendency of the appeal, this Court is not inclined to express any opinion touching the merits of the main case.

Having regard to the facts and circumstances of the case, the learned VIII Additional District and Sessions Judge, Ranga Reddy District at L.B. Nagar is hereby directed to dispose of A.S.No.463 of 2015, as expeditiously as possible, preferably within a period of one (1) month from the date of receipt of a copy of this order. 7.

With the above direction, the Civil Revision Petition is disposed of. There shall be no order as to costs. 8.
