HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18200 OF 2015 ORDER:

This Writ Petition is filed by the petitioners invoking Article 226 of the Constitution of India seeking to declare the inaction of respondents 1 to 5 in considering the representations of the petitioners made on 28.07.2014 and 23.03.2015 as illegal and arbitrary.

Heard the learned counsel for the petitioners as well as the learned Assistant Government Pleader for Revenue for respondents 1 to 3, learned Assistant Government Pleader for I&CAD for respondents 4 and 5. With their consent, the writ petition is disposed of at the stage of admission itself. There is no necessity to put respondent No.6 on notice since this Court is not venturing to adjudicate the case on merits.

Though various grounds are raised in the writ petition, the learned counsel for the petitioners restricts his prayer seeking a direction to the 2nd respondent-Revenue Divisional Officer to consider the representation made by the petitioners on 23.03.2015.

Learned AGP for I&CAD would submit that the respondents may be directed to dispose of the representation made by the petitioners, if the same is still pending consideration. Having regard to the rivals submissions made, the Writ Petition is disposed of directing the 2nd respondent-Revenue Divisional Officer to consider and dispose of the representation made by the petitioners on 23.03.2015 seeking protection of

Sri Karatam Krishnamurthy Yerra Kaluva irrigation reservoir from illegal encroachments alleged to have been made by the 6th respondent, in accordance with law, at the earliest, after hearing the petitioner as well as the other aggrieved persons, if any, including the 6th respondent.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
