THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY TRANSFER CRIMINAL PETITION No.296 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C. seeking to withdraw C.C.No.74 of 2014 pending on the file of XIII Metropolitan Magistrate, Ranga Reddy District, at L.B.Nagar, and transfer the same to the Court of Additional Munsif Magistrate, Kandukuru, Prakasam District.

At the time of hearing, learned counsel for the petitioners has sought permission of this Court to permit the petitioners to withdraw the transfer criminal petition. Learned counsel further submitted that the presence of petitioners 2 and 3 before the trial Court may be dispensed with on each and every date of adjournment.

Permission is granted.

Hence, the Transfer Criminal Petition is dismissed as withdrawn. There is no dispute with regard to the identity of petitioners 2 and 3. Even if the presence of petitioners 2 and 3 is dispensed with, no prejudice would be caused to the first respondent. Hence, the presence of petitioners 2 and 3, who are parents of petitioner No.1, is dispensed with in C.C.No.74 of 2014 before the Court of XIII Metropolitan Magistrate, Ranga Reddy District, at L.B.Nagar, on each and every date of adjournment. However, they shall appear before the trial Court as and when their presence is so required.

Consequently, Miscellaneous Petitions, if any, pending in this Transfer Criminal Petition shall stand closed.
