THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1078 OF 2017 ORDER:

This Contempt Case is filed alleging non-implementation of the order passed by this Court dated 01.09.2016 in Contempt Case No.311 of 2013, Rev.WPMP No.30489 of 2013 in WP No.9203 of 2012, WVMP No.453 of 2016 in WP No.40956 of 2015.

While disposing of the Review Petition along with connected matters, observed that the petitioner is entitled for usual pay and allowances as are admissible to him as on the date of order of termination dated 07.03.2012 till appropriate order is passed by the second respondent pursuant to the enquiry.

Now, the petitioner is continuing in service and no order is passed by the second respondent. By virtue of order of this Court, dated 01.09.2016, the petitioner was paid an amount of Rs.3,32,146/- for the period from 01.08.2015 to 20.07.2017 and an amount of Rs.1,42,985/- for the period from 07.03.2012 to 02.09.2013. 4.

In view of payment of amounts, though it is disputed by learned counsel for the petitioner, the contempt proceedings cannot be continued. If the petitioner is aggrieved, it is for him to agitate his rights in appropriate Forum.

Accordingly, the Contempt Case is closed. Miscellaneous petitions, if any, pending in this contempt case shall stand closed. There shall be no order as to costs.
