The case of the petitioner is that he was placed under suspension with effect from 27-01-2017 vide proceedings No.B2/415/2017/ZPP, dated 06-02-2017 issued by the 1st respondent. The same is being challenged by filing writ petition on the ground that it is passed without application of mind and in a routine manner.

Learned counsel for the petitioner also states that though suspension was with effect from 27-01-2017, the same is not reviewed as per G.O.Ms.No.86, General Administration (Ser-C) Department, dated 08-03-1994 and in terms of judgment of Apex Court in Ajay Kumar Choudhary v. Union of India in Civil Appeal No.1912 of 2015 and also submits that in similar circumstances, the Government has reviewed suspension orders in terms of said judgment vide Memo No.97/SC/A1/2015-2, dated 17-12-2015 but in the case of petitioner, the review was not done.

It is to be seen that the Government has reviewed suspension vide Memo dated 17-12-2015 in terms of

judgment of Ajay Kumar Choudhary v. Union of India and G.O.Ms.No.86, dated 08-03-1994 also provides for review for extension of suspension or otherwise. But in the present case, the petitioner asserts that there was no such review.

In view of the same, the 1st respondent is directed to consider the case of the petitioner for review of suspension order in terms of G.O.Ms.No.86, dated 08-03-1994 and in terms of judgment referred to above and take action accordingly within a period of four weeks from the date of receipt a copy of this order.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 11-08-2017 Nvl
