This Writ Petition is filed seeking to declare the action of respondent No.3 in applying Rule No.9 of G.O.Ms.No.888, dated 08.12.2000, instead of Rule No.14 of G.O.Ms.No.1171, Revenue (Endts-I), dated 16.12.1987, for determination of age of superannuation of the petitioner, as illegal and arbitrary.

2. Learned Assistant Government Pleader for Endowments submits that the petitioner expired and by virtue of the judgment of this Court in Principal Secretary to Government (Revenue/Endowments) Dept., A.P., Hyd.

and another v. Chadavada Koteswara Rao and another1, the age of superannuation of Archakas is 58 years only.

3. Since the petitioner passed away, the cause in the Writ Petition does not survive for adjudication.
