This writ petition is filed seeking the following relief : ".. to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus under Article 226 of the Constitution of India declaring the action of the respondents in not absorbing the petitioner for the post of Lecturer in Zoology in third respondent College, and consequently direct the respondents to absorb the services of the petitioner as Lecturer against vacant aided, permitted post, with effect from 1-8-1994 in third respondent college, keeping in view that the petitioner belongs to Backward Class with high academic qualifications, being woman, having completed long tenure of sincere service and in view of order of the High Court in W.P.No.26402 of 2001, dated 27.12.2001."

No representation for the petitioner.

Heard Sri Pratap Narayan Sanghi, learned counsel for the third respondent.

When the matter is taken up for hearing, it has been submitted by learned counsel appearing for the third respondentInstitution that the petitioner is not working in the third respondent- institution. In view of the same, no relief can be granted to the petitioner.

In view of the above submission of the learned counsel for the third respondent, since the petitioner is not working in the third respondent-institution, there cannot be any direction to the respondents to absorb the services of the petitioner. Accordingly, the writ petition is dismissed as infructuous. No order as to costs.
