HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.32056 OF 2014 ORDER:

The petitioner assails the decision of screening committee/4th respondent in holding the preceding five years mentioned in Clause 2.2.2(A) of tender notice No.SE(R&B)/NH/ATP/79/EPC/DB/2013-14 dated 22.02.2014 relating to the prequalification with reference to last date of application, as illegal, arbitrary and unconstitutional. This Court through order dated 29.10.2014 directed 2nd and 3rd respondents to evaluate the tender of petitioner for pre-qualification criteria.

The respondents filed petitions to vacate the order dated 29.10.2014. At the time of hearing of vacate stay petitions, the Assistant Solicitor General on written instructions from respondent No.5 submits that the Ministry has decided "in principle" for annulling the tender notice No. SE(R&B)/NH/ATP/79/EPC/DB/2013-14 dated 22.02.2014. It is further stated that the consideration of petitioner in the prequalification stage arises, if the tender is processed by the Ministry. By placing on record, the communication dated 03.03.2015, the writ petition is dismissed holding that the cause in the writ petition does not survive. No order as to costs.
