THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.43877 of 2016 ORDER:

The petitioner states that his father late P. Balaiah was recorded as Protected Tenant in respect of the land in Sy.No.76 P, admeasuring Ac.2-28 cents situated in Bandlaguda Jagir, Rajendra Nagar Mandal, Ranga Reddy District. After the death of his father, his mother was in possession of the land and his brother died. The total extent of land in Sy.No.76 is Ac.14-38 gts., and the original owner is one Sri Fida Hussain, whereas the father of the petitioner is a Protected Tenant and his name was recorded in the Khasra Pahani for the year 1954-55. Out of the total extent of land of Ac.14-38 gts., an extent of Ac.12-10 gts., was acquired by the Defence Authorities in the year 1970, compensation was paid by them and only an extent of Ac.2-28 gts., remained. Out of the said extent of land an extent of Ac.1-20 gts., was sold to one M/s.

Abhyudaya Co-operative Housing Society under a decree of the Court in O.S.No.439 of 1998 before the Prl. Subordinate Judge, Ranga Reddy District. The balance extent of Ac.1-08 gts., is remained with the petitioner's possession and enjoyment. Since in the earlier alienations no survey was conducted the petitioner applied for survey on 07-01-2016.

when the survey was not conducted the present writ petition was filed.

The learned Government Pleader, on the basis of instructions, submits that due to shortage of the staff on formation of new Districts the work could not be completed and the work would be completed within four (4) weeks. Recording the said submission of learned Government Pleader, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
