THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 5812 of 2016 ORDER:
The prayer of the petitioner is to direct the District Collector, Kurnool District, to dispose of the petitioner's appeal. The record reflects that the appeal of the petitioner was filed on 19.08.2015. This appeal was preferred by him against the proceedings dated 09.06.2015 passed by the Mandal Revenue Officer, Pagidyala, under Section 10 of the Andhra Pradesh (Scheduled Castes, Scheduled Tribes and Backward Classes) Regulation of Issue of Community Certificates Act, 1993 Being the statutory appellate authority, it is not open to the District Collector, Kurnool District, to keep such an appeal pending indefinitely. The very purpose of the statutory remedy of appeal would be rendered nugatory by such delay in disposal.
The writ petition is accordingly disposed of directing the District Collector, Kurnool District, to consider the petitioner's appeal on merits, give due opportunity of hearing to the parties and pass appropriate orders thereon expeditiously and in any event, not later than one month from the date of receipt of a copy of this order.
Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
