IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) MONDAY, THE SECOND DAY OF FEBRUARY TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.1646 of 2015 BETWEEN K.V.L.Tulasamma and another ... PETITIONERS AND The State of A.P. rep. by its Principal Secretary, Consumer Affairs, Food and Civil Supplies Department, Secretariat, Hyderabad and others ...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. The grievance of the petitioners is that in spite of their applications filed for release of the vehicle as early as on 07.01.2015, no orders are passed by respondent No.2. Petitioners state that two oil tanker vehicles together with PDS Kerosene Oil, Crude Oil and Engine Oil were seized on 13.09.2014. Thereafter, on the request of the petitioners, respondent No.2 has passed release order dated 18.11.2014 so far as seized oils are concerned subject to the condition of furnishing bank guarantee for 75% of the value of the seized stock. Thereafter, the Joint Collector has passed a further order on 24.12.2014 releasing one of the oil tankers viz., AP 29T 3381 subject to the condition of furnishing Bank guarantee for a sum of Rs.2,86,000/-. However,
so far as the other vehicle of the petitioners bearing No.AIC 3555 is not yet ordered to be released. Petitioners states in the application that the value of the said vehicle itself is Rs.1,80,000/- and that petitioners be permitted to give bank guarantee for an appropriate amount.
3. Since the petitioners' applications are pending with respondent No.2 since 07.01.2015 and since already two release orders are passed by respondent No.2, as referred to above, I deem it appropriate to dispose of the writ petition directing respondent No.2 to pass appropriate orders on the petitioners' application for release dated 07.01.2015 on or before 07.02.2015. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
