THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18604 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the second respondent at the instance of the third respondent to evict the petitioner from the premises bearing H.No.6-2-133 situated at M.G.Road, Kothagudem, without preferring due course of law by preferring execution petition as contemplated in Lok-Adalath Case No.212 of 2013 pertaining to O.S.No.

42 of 2013 on the file of the Learned Principal Junior Civil Judge is illegal, arbitrary null and void and in violation of Lok-Adalath award dated 07-12-2013 passed by the Lok-Adalath Bench at Kothagudem and consequently direct the second respondent at the instance of the third respondent not to evict the petitioner from the premises bearing H.No.6-2-133 situated at M.G. Road, Kothagudem, without preferring due course of law by preferring execution petition as contemplated in Lok-Adalath Case No.212 of 2013 pertaining to O.S.No.42 of 2013 on the file of the Learned Principal Junior Civil Judge and in compliance of Lok-Adalath award dated: 07-12-2013 passed by the LokAdalath Bench at Kothagudem and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

The main grievance of the petitioner in this writ petition is that respondent No.2, at the instance of respondent No.3, is trying to evict the petitioner from the aforesaid premises without following the due process of law.

When the matter is taken up for hearing, it is informed by the learned Standing Counsel appearing for respondent No.2 that

it is a dispute between the petitioner and respondent No.3 and in any way, respondent No.2 is not concerned with the said dispute. Further, he informed that respondent No.2 is not interfering in any of the affairs between the petitioner and respondent No.3. 4.

Recording the submission of the learned Standing Counsel, the Writ Petition is disposed of. There shall be no order as to costs. 5.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
