HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.25142 of 2014 ORDER:

The case of the petitioners is that they are the successors of late Gangu Naidu and they are in peaceful possession of land to an extent of Ac.0-74 cents in Sy.No.299/5 of Amruthapuram Village, Sabbavaram Mandal, Visakhapatnam, since their forefathers and originally the land covered in old Sy.No.229/3 and New Sy.No.299/5 admeasuring Ac.01-75 cents was Inam land given by Rajasaheb of Vizianagaram during the year 1900 to Gandi Kanaiah and Gangu Naidu Since the date of granting Inam, the petitioner's forefathers and after them, the petitioners are continuing the peaceful possession. In the year 2008, notices were received from the 3rd respondent for eviction of the subject lands, by that time the petitioners and other successors of Gangu Naidu filed an application dated 22-04-2008 for grant of ryotwari patta for the said land and the same is pending.

The respondents are trying to evict the petitioners. Aggrieved by the same, the present writ petition is filed.

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

It is stated by learned counsel for the petitioners that when eviction orders were passed, this Court granted

interim orders in WP.No.11593 of 2008 filed by the legal heirs of Gandhi Ganga Naidu. Since the application filed by the petitioners is stated to be pending, it is for the authorities to dispose of the same.

In view of the same, the 2nd respondent is directed to dispose of the application dated 22-04-2008 filed by the petitioners, if any pending, in accordance with law. Till then, there shall be status quo obtaining as on today. However, this order shall not preclude the competent authority to take action after following due process of law. Accordingly, the writ petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
