THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.14599 OF 2014 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for respondents 1 to 4. 2.

The prayer sought in the writ petition is as under: "For the reasons stated in the accompanying affidavit the petitioner herein prays that this Hon'ble Court may be pleased to issue a Writ of Mandamus or other appropriate order or direction in the nature of a Writ directing the respondent police particularly respondent No.4 not to interfere in any manner with the ongoing civil litigation in O.S.No.100/2014 on the file of the Hon'ble XXIV Addl. Chief Judge, City Civil Court, Hyderabad filed by the petitioner for specific performance by putting pressure on him to vacate the subject premises after declaring their high handed action in interfering with the civil dispute as arbitrary, discriminatory and violative of Articles 14 and 21 of the Constitution of India in the interest of justice and pass such other or further orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

During the course of hearing, the learned Government Pleader placed on record notice vide No.270/Cr/AFZ-PS/14, dated 10.05.2014, issued by the Sub-Inspector of Police, Afzalgunj Police Station, Hyderabad.

From the perusal of the said notice, it is revealed that on 01.05.2014 at 10.15 hours, the 4th respondent received a complaint from one Sri Abdul Rasheed, S/o. Abdul Razak against the petitioner. In that regard, a case in Crime No.270 of 2014 for the offences under Sections 419, 420, 406, 120-B and 506 IPC read with 34 IPC was received under Section 156(3)

PKR,J W.P.No.14599 of 2014 Cr.P.C. at Afzalgunj Police Station, Hyderabad. Pursuant to the registration of the said crime, investigation was taken up. In that connection, the petitioner was instructed to appear before the 4th respondent on or before 13.05.2014 for giving explanation or submit his written version; otherwise the petitioner will be arrested in the above crime. 5.

The learned Government Pleader also, on instructions, submit that except enquiring with the petitioner in connection with Crime No.270 of 2014, the respondent Police never interfered in any matter relating to civil litigation in O.S.No.100 of 2014, on the file of XXIV Additional Chief Judge, City Civil Court, Hyderabad, filed by the petitioner and putting pressure on him to vacate the subject premises.

Taking the above said statements into consideration, this Court is of the opinion that no further cause would survive and the same is liable to be closed.

Accordingly, the Writ Petition is closed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
