As there was no representation for the appellant on 13.10.2016, the matter was directed to be listed on 14.10.2016 under the caption "for dismissal". However, subsequently learned counsel made a request to post the matter for appearance and it was so posted. 2.

Even today, despite the matter being listed under the caption "for appearance", when the matter is called, there is no representation for the appellant and even appellant has not appeared. 3.

Accordingly, this appeal is dismissed for non-prosecution. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
