THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2812 of 2015 ORDER:

This Criminal Revision Case is filed by the petitioner aggrieved by the order dated 12.11.2015 passed in C.F.R.No.1089 of 2015 in Crime No.251 of 2014 on the file of Judicial First Class Magistrate at Mahabubabad. By the impugned order the Court below returned the petition for want of jurisdiction that was filed by the petitioner under Section 451 Cr.P.C. seeking direction to 2nd respondent to return FDR No.0394104 for Rs.1,08,750/- drawn on Indian Bank, Mahabubabad branch by accepting third party surety as the petitioner is in need of money to meet her domestic necessities.

Heard and perused the material available on record. Admittedly, the case is pending in Crime No.251 of 2014 on the file of Mahabubabad Town Police Station, Warangal District. According to the petitioner, she has to meet family financial necessities. Considering the same, the second respondent is directed to return half of the amount covered by the above FDR on condition of petitioner executing a personal bond for the said amount. Accordingly, the revision is disposed of.
