HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 19151 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as a Fair Price Shop Dealer for Shop No. 43 of Vizianagaram town and District on regular basis. While so, pursuant to the report submitted by the Dy.Tahsildar (CS), the fourth respondent suspended the authorization of the petitioner on 03.09.2011. Challenging the same, the petitioner preferred an appeal before the third respondent, who confirmed the order of the fourth respondent

dated 3.9.2011. Against the same, the petitioner preferred a revision before the second respondent and the said revision is pending. Challenging the order of the fourth respondent dated 3.9.2011 as confirmed by the third respondent by order dated 9.4.2012, the present Writ Petition is filed. The impugned order of suspension of authorization of the petitioner was passed on 3.9.2011 on the ground that 35 bogus ration cards are existing in the shop. With regard to the same, the enquiry ought to have been completed by the fourth respondent within a period of 90 days though the revision preferred by the petitioner is pending and the enquiry officer should not have taken into consideration the pendency of the revision for completion of the enquiry.

In view of lapse of three and half years from the date of order suspending the authorization of the petitioner, the fourth respondent is directed to complete the enquiry relating to the allegations made against the petitioner in the order dated 3.9.2011 within a period of 60 days from the date of receipt of a copy of this order by duly following the principles of natural justice.

The Writ Petition is disposed of accordingly. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
