THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY Writ Petition No.37977 of 2015 Dated 25th November, 2015 Between:

Varshini Mansion Flat Owners Welfare Association

...Petitioner

And The State of Telangana, rep.by its Principal Secretary, Municipal Administration & Urban Development, Secretariat, Hyderabad and others

...Respondents

Counsel for the petitioner: Sri G.Thirupathi Reddy Counsel for respondent No.1: GP for Municipal Administration (TS) The Court made the following:

ORDER:

Feeling aggrieved by the inaction of respondent Nos.2 and 3 in removing the illegal constructions made by respondent Nos.4 to 7, the petitioner filed this writ petition.

At the hearing, Sri Sampath Prabhakar Reddy, learned Standing Counsel for GHMC appearing for respondent Nos.2 and 3, placed before the Court a copy of the report of respondent No.3, along with photographs, showing that the shops in stilt floor are removed. The report also stated that the objections raised by the private respondents were disposed of on 23.11.2015 and a final notice under Section 636 of the Greater Hyderabad Municipal Corporation Act, 1955 was issued on 23.11.2015 for removal of pent house constructed unauthorisedly. The learned Standing Counsel submitted that the Corporation is determined to remove the illegal constructions as early as possible.

In the light of the above noted facts, this Court is convinced that respondent Nos.2 and 3 have taken appropriate action, albeit belatedly. Hence, the writ petition is closed.

As a sequel to disposal of the writ petition, WP.M.P.No.48856 of 2015 shall stand disposed of as infructuous.
