HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 2707 of 2004 ORDER:
This writ petition is filed seeking to issue a writ of certiorari calling for the record relating to and connected with I.D.No.26 of 2001 on the file of the 1st respondent-Tribunal and quash the order dated 31.12.2001 passed therein holding it as illegal and arbitrary. Heard learned counsel for the petitioner and learned Government Pleader for the 2nd respondent.
It has been contended by the petitioner that he was appointed as watchman on daily wages with the 2nd respondent. While so, his services were terminated on 01.04.1992 orally contrary to Section 25(f) of the I.D. Act. It is further contended that he was neither served with any notice nor paid any compensation amount. Questioning the termination orders, he filed I.D.No.26 of 2001 on the file of the 1st respondent-Tribunal. The Tribunal without properly appreciating any of the contentions raised by him dismissed the said I.D. vide orders dated 31.12.2001. Aggrieved thereby, he filed the present writ petition.
Learned Government Pleader for the 2nd respondent has contended that the Tribunal has rightly dismissed the I.D. filed by the petitioner and, therefore, no interference is called for. This Court, having considered the submissions made by the learned counsel for the parties and perused the record, is of the
considered view that the Tribunal has rightly dismissed the I.D. filed by the petitioner. Further, no illegality or irregularity is pointed out by the learned counsel for the petitioner in the order passed by the Tribunal. Unless and until any illegality or irregularity is pointed out by the learned counsel for the petitioner in the order passed by the Tribunal, this Court cannot interfere with the findings of the Tribunal. There are no merits in the writ petition.
Therefore, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
