THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2198 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.453 of 2014 on the file of the IV Additional Judicial First Class Magistrate, Chittoor, Chittoor District, arising out of offences under Sections 420, 423 IPC read with Section 34 IPC.

Heard and perused the material available on record. Learned counsel for the petitioner submits that the case is arising out of execution of sale deed and that the petitioner is only an attestor to the said document, that the petitioner is not aware of the contents of the document, and as such, he prays this Court to quash the proceedings against the petitioner herein. This Court is of the view that as the case before the Court below is at the stage of framing of charges, the petitioner is given liberty to file an application raising all the grounds seeking discharge and the Court below is directed to consider the application on hearing the petitioner and on perusing the records and pass appropriate orders in accordance with law. Till then, the presence of the petitioner is dispensed with before the Court below.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 23.02.2016 pln
