Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself.

The present Writ Petition came to be filed seeking to declare the action of respondent Nos.2 to 5 in trying to evict the petitioner from the land admeasuring Ac.0.81 cents situated in Survey No.943/3, Bapatla East, Bapatla, Guntur District, without issuing any notice and without following due process of law, as illegal and arbitrary.

The averments in the affidavit filed in support of the Writ Petition is that the petitioner is in possession of land admeasuring Ac.0.81 cents situated in Survey No.943/3, Bapatla East, Bapatla, Guntur District. The petitioner has been in continuous possession and enjoyment of the land since last 25 years and was cultivating the land. It is stated that all of a sudden, respondent Nos.2 to 5 entered into the land of the petitioner and directed her to vacate the land, apart from obstructing her from cultivating the said land. It is stated that without following any process of law or even without issuing notices, the petitioner was sought to be evicted from the said land, which has been in the possession of the petitioner since 25 years.

Learned Government Pleader submits that the allegation in the Writ Petition that the respondents have highhandedly attempted to evict the petitioner is incorrect and that the procedure as contemplated under law will be followed before taking any coercive steps towards the petitioner.

Without going into merits of the case and having regard to the circumstances stated above, the present Writ Petition is disposed of directing the respondents not to dispossess the petitioner from the land admeasuring Ac.0.81 cents in Survey No.943/3 Bapatla East, Bapatla, Guntur District, without following due process of law, if she is in possession of the property. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this Writ

Petition shall also stand closed.
