THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NOS.10751 & 10733 OF 2023 COMMON ORDER:

These Criminal Petitions are filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.3 and respectively in Crime.No.309 of 2023 on the file of Mangalhat Police Station, Hyderabad, registered for the offence under Section 8(c) r/w. 20(b) (ii) (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Since the petitioners in both the petitions are accused Nos.1 and 2 respectively in the very same crime, both the petitions are heard together and disposed off by this common order.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the Mangalhat Police is that on 09.10.2023 on receiving information, they have conducted raid in a house wherein these petitioners along with others found in possession of 2 kgs. of ganja and cash of Rs.3,07,500/-. The Police apprehended these petitioners and remanded to judicial custody.

Learned counsel appearing for the petitioners would submit that only 2 kgs. of ganja was seized from these petitioners which is less than commercial quantity and sought for relief of bail.

However, keeping in view that the contraband seized from these petitioners is less than the commercial quantity and petitioners being the women, this Court is inclined to grant the relief of bail, subject to following conditions. i) The petitioners/Accused Nos.3 and 2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of I Additional Metropolitan Sessions Judge, Hyderabad.

ii) The petitioners/Accused Nos.3 and 2 after release shall appear before the concerned Station

House Officer everyday at 10:00 a.m. for a period of two weeks and thereafter, as and when required. iii) The petitioners/Accused Nos.3 and 2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, these Criminal Petitions are allowed. Miscellaneous applications, pending if any, shall stand closed.
