HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.5378 of 2015 ORDER:
Heard.
This writ petition is filed alleging that respondent police particularly respondents 3 and 4 are harassing the petitioners by repeatedly calling them to the police station without there being any crime registered.
Learned Government Pleader has received instructions from the 3rd respondent, which state that the 5th respondent has filed a complaint on 31-12-2014 against the petitioners, based on which a case in Cr.No.875 of 2014 is stated to have been registered on 31-12-2014 before the 3rd respondent and investigation is taken up. It is also stated that if involvement of the petitioners is found in the said case, appropriate action will be taken against them by following due procedure including issuance of notice under Section 41-A Cr.P.C. So far as the 4th respondent is concerned, learned Government Pleader reported that no crime is registered on the file of the 4th respondent police station and as such, the allegation of the petitioners that the 4th respondent is interfering with their personal life and liberty is not substantiated.
Since the 3rd respondent has already taken up investigation in the said crime, no further directions are required to be issued except directing the 3rd respondent to complete the investigation by following due procedure and file appropriate charge-sheet/final report before competent court.
Accordingly, the writ petition is disposed of. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall
stand closed.
