ORDER:

The petitioner claims to be the devotee of Lord Mahadev Temple situated at Feelkhana, Begum Bazar, Hyderabad. The sum and substance of the allegations in the writ petition are that the 6th respondent has encroached into the Temple land. The petitioner filed this writ petition alleging that respondent Nos.2 and 3 are illegally allowing respondent Nos.6 and 7 to make unauthorized and illegal constructions over the Mahadev Temple Land admeasuring 1958 sq. yards, 1861 Sq. meters, situated at the premises bearing No.15.01.652 to 656, T.S.No.21, Block J, Ward 49, Feelkhana, Begum Bazar, Hyderabad.

Learned counsel for the petitioner contended that the 6th respondent has entered into a private agreement with the 7th respondent and without any title over the land, he is handing over the property to the 7th respondent and they are in the process of making constructions over a extent of 1210 sq. yards of the temple land by creating fake documents.

Heard learned counsel for the petitioner, learned Government Pleader for Revenue for respondent Nos.1 and 5 learned Government Pleader for Endowments for respondent Nos.2 and 3, and Sri N. Ashok Kumar, learned Standing Counsel appearing for respondent No.4. Inasmuch as the allegation of the petitioner is against the 6th respondent, the petitioner can seek appropriate remedy before the appropriate authority by bringing to their notice all the facts in support of his allegation. Though elaborate pleadings have been made in the writ petition, since the petitioner had not approached the primary authority, who is enjoined with the duty to protect the temple properties, I am not inclined to entertain this writ petition. However, I

deem it appropriate to grant liberty to the petitioner to approach respondent Nos.2 and 3 and submit a representation within a period of two weeks from today by bringing to their notice about the alleged illegalities committed by respondent Nos.6 and 7, and seek appropriate orders.

With the above observations, the writ petition is disposed of. As a sequel, pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
