Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.
2. The petitioner was appointed as a fair price shop dealer of shop No.24 of Govada Village, Amarthalur Mandal, Guntur District on temporary basis. While so, on 29.06.2015, the Sub-Inspector of Police, Sandole Police Station, intercepted one Tata Ace vehicle bearing No.AP 07 TC 2988 and found 5 drums of kerosene oil and seized the same. Based on the statement made by the driver of the said vehicle, Crime No.47 of 2015 was registered. The third respondent issued a show cause notice on 27.07.2015 and the petitioner submitted his explanation on 10.08.2015. After considering the explanation, the third respondent passed the impugned order on 10.08.2015 suspending the authorization of the petitioner. Challenging the same, the present writ petition is filed.
3. A perusal of the impugned order shows that as many as 5 charges were leveled against the petitioner and the nature of charges require further enquiry by the third respondent. In view of the same, this Court is not inclined to interfere with the enquiry process at this stage. However, the third respondent is directed to conduct an enquiry in respect of the allegations leveled against the petitioner and complete the same, within a period of two months from the date of receipt of a copy of this order, by giving due opportunity to the petitioner.
4. The writ petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
