HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43195 OF 2016 ORDER:

This writ petition is filed declaring the action of the 3rd respondent in issuing notification dated 05.05.2016 which was published in Andhra Jyothi Daily Newspaper on 05.05.2016 that certain survey numbers bearing 567/1A1 admeasuring an extent of Ac.81.00 sq.mts situated at Rustumbanda, Narsapur Municipality, West Godavari District, without following due process of law, as illegal and arbitrary.

Heard the learned counsel for the petitioner and Sri S.S.Varma, the learned Standing counsel for respondents 1 and 2. Since it is stated that there are disputes between the petitioner and her sons i.e., Elamala Samuel Sundeep and Elamala Sudheer Paul and since the respondents issued notice under Section 3H(2) of the National Highways Laws (Amendment) Act, 1997 only to Elamala Samuel Sundeep, the respondents are directed to issue notice to petitioner's another son i.e., Elamala Sudheer Paul and thereafter consider their objections and pass appropriate orders thereon as per law.

With the above direction, the writ petition is disposed of. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 14-12-2016 dv
