HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.7421 of 2006 ORDER :
Despite the fact that the writ petition is listed under the caption "FOR DISMISSAL", when the matter is taken up for hearing, none appears for the petitioners.
A perusal of the record discloses that the petitioners have filed this writ petition seeking Writ of Mandamus declaring the action of the respondents in not disbursing the pension to the petitioners on or before 5th of every succeeding month and in not revising the pension after making valuation of the pension fund for every three years, as illegal, arbitrary and contrary to the provisions of the Coal Mines Provident Fund and Miscellaneous Provisions Act, 1948 and the Coal Mines Pension Scheme, 1998 and sought for a consequential direction to the respondents to disburse the pension to the petitioners on or before 5th of every succeeding month with a further direction to pay all arrears of pension to the petitioners. This Court, vide order dated 04.06.2007, was pleased to pass interim orders directing the respondents to disburse the arrears of pension to the petitioners, if not already paid, within a period of six weeks from the date of receipt of a copy of the said order.
AKS, J W.P.No.7421 of 2006 Having perused the record, this Court is of the considered view that this writ petition can be disposed of directing the respondents to disburse the pension to the petitioners on or before 5th of every succeeding month with a further direction to pay all arrears of pension to the petitioners, if not already paid, within a period of four (4) weeks from the date of receipt of a copy of this order.
With the above observations, the writ petition is disposed of. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
