HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.28620 OF 2013 ORDER (ORAL) :

This writ petition is filed seeking to declare the proceedings in Rc.No.1966/E1/2013 dated 30.08.2013 to close the petitioner's School viz., Sri Sai Vidyanikethan situated at Galipalli Village, Ellanthakunta Mandal, Karimnagar District, as being illegal, arbitrary, unjust, and contrary to the Government Orders issued in G.O.Ms.No.1, Education (P.S.2), dated 01.01.1994 i.e., A.P.

Educational Institutions (Establishment, Recognition, Administration and Control of Schools under Private Management) Rules, 1993.

2. Heard Sri Srinivasa Rao Potluri, learned counsel for the petitioner, and learned Government Pleader for Education appearing for the respondents, and perused the material on record.

The learned counsel for the petitioner would submit that pursuant to the interim orders of this Court dated 07.10.2013, the petitioner's School has been continued and thereafter the authorities concerned granted renewal from time to time. The said fact is not disputed by the learned Government Pleader for Education.

4. Since recognition of the petitioner's School stands renewed from time to time by the authorities concerned, the impugned proceedings under which the petitioner's school was earlier directed

to be closed needs no further adjudication. Though it is stated in paragraph No.5 of the counter affidavit that there are certain allegations with regard to functioning of the petitioner's School with fake recognition orders, it is submitted by the learned counsel for the petitioner as well as learned Government Pleader for Education that the same does not pertain to the petitioner's School.

5. In view of the above submissions, further adjudication in this writ petition is not called for and no further orders are required to be passed in the matter.

6. Accordingly, the writ petition is closed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition stand closed.
