HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4792 of 2015 ORDER:

This petition is filed by the petitioner-accused under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail to him in Crime No.55 of 2015 of P.S. Charminar, Hyderabad, registered for the offence punishable under Section 364-A IPC.

Heard and perused the material available on record. The grandfather of the victim-girl lodged a complaint stating that his granddaughter aged about two years was found missing near the High Court Premises. Then the police collected video footage from gate No.6 of the High Court and identified the accused and rushed to Guntur town and traced out the victim-girl.

It is apparent that the victim-girl was found in possession of the petitioner at Guntur and there is no proper explanation from the petitioner for his act of taking away the child to Guntur. Therefore, this Court is of the view that the petitioner is not entitled to grant any bail to the petitioner at this stage.
