THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.26147 of 2018 ORDER:
Heard Mr.V.Sudhakar Reddy for petitioner and the learned Assistant Government Pleader for Revenue.
The petitioner prays for the following relief :- " ........ to issue an order, direction or writ, more particularly one in the nature of writ of Mandamus declaring the proceedings in Rc.B.245/ 2018, dt.30.06.2018 issued by the Tahsildar, Kaligiri, SPS Nellore District, the 4th respondent herein, wherein and where under directed the removal of the name of the petitioner from web land in respect of Ac.1-10 cts situated in Sy.No.351/ 5 of Thellapadu village, Kaligiri Mandal, SPS Nellore District and to hand over Ac.0-41 cts out of Ac.1-91 cts to the Gram Panchayat to utilize for the purpose of grave yard and to keep the remaining Ac.1-50 cts in reserve to utilize the same for house sites in future as illegal, arbitrary, violation of principles of natural justice and without any authority of law or jurisdiction and set aside the same......"
Mr.V.Sudhakar Reddy submits that the then Tahsildar of Kaligiri Mandal, on the last day in office as Tahsildar, has directed deletion of petitioner's name from the revenue record. The further objection against the proceedings impugned is that the petitioner was not put on notice at all. The petitioner in the case on hand is substantially aggrieved by the change of entries in the revenue records.
Against the order dated 30.06.2018 passed by the 4th respondent, the petitioner can file appeal before the 3rd
respondent. Hence, this Court is not persuaded to entertain the writ petition.
The writ petition is disposed of by this order. (a) The petitioner is given liberty to file appeal within two weeks from the date of receipt of a copy of this order by enclosing a copy of this order. (b) The 3rd respondent-appellate authority examines the grievance of petitioner and disposes of the appeal within three months thereafter.
(c) The parties are directed to maintain status-quo as regards entries in the revenue records as on date during pendency of appeal.
Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
