The grievance of the petitioner is that he is the owner of the property of an extent of 253.33 Sq.yards bearing D.No.53.1.11, S.No.57, Fish Market Area, Maddipalem, Visakhapatnam and he acquired the said property through Gift Settlement deed dated 13.08.2008 executed by his paternal grandparents in his favour through regd.document No.3624 of 2008. It is further stated that after obtaining building permission from the 2nd respondent for constructing Stilt+GF+2 upper floors, the petitioner has completed the construction of residential complex without deviations in the above said property and he also constructed a small room in the stilt portion for watchman residence. It is further stated that on 06.03.
2015 the respondent authorities have visited the residential complex of the petitioner and directed to remove the watchman room which is constructed in the stilt portion and the same is meant only for parking. Hence, the present writ petition. On the other hand, Sri S.Laxminarayana Reddy, learned standing counsel for 2nd respondent submits that the petitioner has constructed six shops in the stilt portion apart from watchman room deviating the approved plan and hence the respondent authorities have informed the petitioner to remove the shops constructed in the stilt portion, which is meant for only parking purpose.
Learned counsel for the petitioner states that the writ petition can be disposed of confining the relief to the watchman room only.
In view of the said submission made by the learned counsel for the petitioner, the writ petition is disposed of at the stage of admission granting liberty to the respondent authorities to take appropriate steps in accordance with law in removing the shops constructed by the petitioner in the stilt portion leaving the room meant for watchman residence purpose. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
