HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 19051 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner is appointed as a Fair Price Shop Dealer of Allampur Village, Kadiri Mandal, Ananthapur District. While so, on 8.4.2015, the fourth respondent along with his subordinates inspected the shop of the petitioner and conducted panchanama and seized the stock. Thereafter, the fourth respondent submitted his report to the second and third respondents, based on which, the third respondent issued show cause notice-cum-suspension order by proceedings dated 16.4.2015. The said order is challenged in the present Writ Petition.

This Court carefully perused the charges mentioned in the impugned order of suspension and in view of the opportunity given to the petitioner to submit his explanation, this Court is not inclined to interfere with the impugned order passed by the third respondent on 16.4.2015. However, the third respondent is directed to conduct enquiry in respect of the allegations levelled against the petitioner and pass final order within a period of 30 days from the date of receipt of a copy of this order by duly observing the principles of natural justice.

Subject to the above, this Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
