HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42981 of 2016 ORDER:

1.

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking a direction to the 3rd respondent not to force her to settle the civil disputes between the unofficial respondents, who lodged a complaint against the petitioner, and the petitioner. 2.

Heard and perused the material available on record. 3.

It is alleged that the petitioner and her children filed a suit against the 4th respondent for grant of permanent injunction. While so, the 4th respondent lodged a complaint against the petitioner and her family members alleging that they trespassed into his plot. Basing on the said complaint a case was registered against the petitioner and others. After registration of the crime, the 3rd respondent threatened the petitioner and her family members and forced them to settle the civil disputes with the 4th respondent.

4.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:

"The 3rd respondent is directed not to compel the petitioner and her family members to settle civil disputes between the 4th respondent and the petitioner."

5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 9th December, 2016 Nn
