This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: " ...to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents authorities in not appointing the petitioner as Fair Price shop dealer No.613 of Swaroopnagar, Uppal, Uppal Mandal, Medchal District by considering the petitioner representation dt 16-11-2015 as illegal, arbitrary and against the principles of natural justice in contrary to the G.O.Ms.No.4 dt.28-02-2014 of Civil Supplies Department and consequently direct the 3rd respondent to appoint the petitioner as Fair Price Shop dealer No.613 of Swaroopnagar, Uppal, Uppal mandal, by considering the petitioner representation dt.16-11-2015 as per the G.O.Ms.No.4 dt.28-022014 and to pass such other orders as are necessary in the interests of justice."
Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies and perused the prayer in the writ petition with supporting affidavit and the representation of the petitioner dated 16-11-2015 submitted to the 3rd respondent-Revenue Divisional Officer-cum-Special Grade Deputy Collector, which is acknowledged by the office of the 3rd respondent on the even date itself.
Learned Government Pleader for Civil Supplies submits that the respondent Authorities will consider the representation of the petitioner and pass appropriate orders.
As per condition No.6(i) of G.O.Ms.No.4 dt.28-02-2014, compassionate appointment is in death cases to consider the legal heirs/ heiress.
Having regard to the above and from the submission of learned Government Pleader for Civil Supplies, the Writ Petition is disposed of directing the respondent Authorities to consider the representation of the petitioner and pass appropriate orders within a period of four weeks from the date of receipt of copy of this order. If the petitioner has any further grievance, it is left open to him to agitate the same in accordance with law. Consequently, miscellaneous petitions, if any, pending shall stand closed. No costs.
