HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.36461 of 2015 ORDER :

Petitioner contends that he joined service as Junior Assistant (LDC) in A.P. State Wakf Board in 1984 when the combined state of A.P. was in existence and subsequently he earned his promotion as Senior Assistant in 1988 and

thereafter as Superintendent in 2006 and presently he is working in the cadre of Law Officer Grade-II. Petitioner is now aspiring promotion as Assistant Secretary.

According to the petitioner his junior is promoted as Assistant Secretary when the Board was common to both states before bifurcation and even then he was with a fond hope that at least after bifurcation he would be considered for promotion as Assistant Secretary. Since, so far the said promotion is not granted to him, he made representation seeking promotion to the post of Assistant Secretary and aggrieved by the in action of the respondents in considering his representation, this writ petition is filed.

Learned Standing Counsel for respondents submits that now the Board is bifurcated and separate Boards have been constituted to two states and after constitution of the separate Wakf Board to the State of A.P., the grievance agitated by the petitioner is placed before the Competent Authority, A.P. State Wakf Board, which constituted an Expert Committee vide proceedings dt.13.11.2015 consisting of three members for scrutinizing the subject service matter and to submit report for taking further action. He further submits that the representation of the petitioner is being placed before the said committee for its consideration and making appropriate recommendations. The copy of the proceedings dt.13.11.2015 is placed before me.

4. As seen from the said proceedings, the issue for consideration before the Committee is only regarding the grievance of the petitioner as to his promotion as Assistant Secretary. I am therefore of the opinion that the period of one month granted therein to submit report is unreasonable and is on higher side.

Therefore, this Writ Petition is disposed of without expressing any opinion on merits and directing the respondent-The Andhra Pradesh State Wakf Board to take appropriate decision as warranted by law on the claim of the petitioner for promotion as Assistant Secretary, including finalization of the

recommendations made by the Committee constituted vide proceedings dt.13.11.2015, within a period of four (04) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

6. As a sequel, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
