THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.19916 of 2015 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner was appointed as a fair price shop dealer of shop No.20, Kondavenkapalli Village, Tanakal Mandal in Guntur District. However, basing on the report of the third respondent, dated 21.04.2015, the second respondent issued a suspension-cum-show cause notice to the petitioner on 15.05.2015 framing four charges. Challenging the same, the present Writ Petition is filed.

Learned Counsel for the petitioner submits that on an earlier occasion also, the dealership of the petitioner was suspended by proceedings dated 20.10.2014 and when he submitted his explanation, the proceedings were dropped. However, the present suspension-cumshow cause notice is issued simply based on the report of the Tahsildar, dated 21.04.2015.

I have carefully perused the charges mentioned in the present suspension-cum-show cause notice and this Court feels that they require enquiry.

In the circumstances, the Writ Petition is disposed of directing the second respondent to conduct an enquiry in respect of the allegations and complete the same within a period of thirty days from the date of receipt of a copy of this order by observing principles of natural justice. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 02.07.2015
