THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11584 OF 2015 ORDER :

This writ petition is filed for writ of mandamus declaring the action of the respondents in refusing to receive and process application for building permission to an extent of 201.00 sq.yards bearing Municipal No.1-9-8/4/1, situated at Ramnagar, Zamistanpur, Hyderabad, as it is not accompanied with Town Survey Land Record Certificate and No Objection Certificate, as illegal and arbitrary and consequently to direct the respondents to receive and process the application for building permission without insisting for Town Survey Land Record Certificate and No Objection Certificate. It is stated by Sri Sreenivasa Rao Velivela, learned counsel for the petitioner that the lis in the present writ petition is squarely covered by the orders of this Court in W.P.No.6068 of 2015 dated 11.03.2015 and the same is not disputed or denied by Sri R.Radha Krishna Reddy, learned Standing Counsel for respondent Corporation.

In view of the said representation, following the ratio laid down in the said Judgment dated 11.03.2015 in W.P.No.6068 of 2015, this writ petition is disposed of directing the respondent GHMC to take appropriate decision on the application made by the petitioner seeking permission to construct a building, in accordance with the provisions of the Greater Hyderabad Municipal Corporation Act, 1955 and the Building Rules and Regulations made thereunder, without insisting for production of TSLR Certificate and No Objection Certificate from the Revenue authorities.

There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 21.04.2015
