HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.527 of 2015 ORDER:
The petitioner, who worked as Executive Accountant in M/s.Sipra Labs Private Limited, Sanathnagar, discontinued the job and sought return of his original documents submitted at the time of employment with the said Company.
On the ground that his documents are not returned by the Company and the Managing Director is demanding Rs.2,00,000/- for return of his documents, , he filed a private complaint, based on which, a case in Cr.No.613 of 2014 is registered for the offences punishable under Sections 406, 420, 384 and 506 IPC by Sanathnagar Police Station on 09-12-2014. While the said criminal case is pending, the petitioner filed the present writ petition alleging that the 5th respondent is repeatedly calling him from his Mobile Phone No.7382260941 and pressurizing him to settle the dispute with the accused. The petitioner further alleges that no proper investigation is being conducted in Cr.No.613 of 2014. I have heard the learned Government Pleader for Home.
It is evident that on the basis of the orders of the concerned Criminal Court, the private complaint of the petitioner in Cr.No.613 of 2014 is already registered on 09-12-2014. The 4th respondent-Station House Officer shall therefore confine his officers with regard to investigation of the said crime and shall take appropriate steps to ensure that police authorities do not pressurize the petitioner for settlement of dispute. The 4th respondent shall investigate the said crime as expeditiously as possible and file appropriate report/chargesheet before the jurisdictional criminal court expeditiously. Accordingly, the writ petition is disposed of. No order as to costs.
The miscellaneous petitions, if any, pending in this writ petition
shall stand closed.
