THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.11794 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings against the petitioners/respondents 1 to 4 in D.V.C.No.14 of 2015 on the file of Additional Judicial Magistrate of First Class, Nirmal.

At the time of arguments, learned counsel for the petitioners has sought permission of this Court to permit the petitioners to withdraw the criminal petition. He further submitted that the presence of the petitioners may be dispensed with before the trial Court.

A perusal of the record reveals that the petitioners herein are respondents 1 to 4 and the second respondent is the applicant in D.V.C.No.14 of 2015. Even if the presence of petitioners 2 to 4 herein is dispensed with, no prejudice would be caused to the applicant in DVC No.14 of 2015.

Hence, permission granted and the Criminal Petition is dismissed as withdrawn. The presence of the petitioners 2 to 4/respondents 2 to 4 in D.V.C.No.14 of 2015 on the file of Additional Judicial First Class Magistrate, Nirmal, is dispensed with before the trial Court on each and every date of adjournment. However, they shall appear before the Court as and when their presence is so required.

Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
