THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION Nos. 32696 of 2015 and 15045 of 2016 COMMON ORDER:

Heard Mr.K.V.L.Narasimha Rao for petitioners and learned Assistant Government Pleader for respondents. 2.

The Assistant Government Pleader places on record written instructions, dated 18.01.2017. With the assistance of counsel for respondents, I have gone though the written instructions. Admittedly, notice, dated 14.09.2015, was issued and according to respondents on 11.04.2016 an extent of Ac.0.04 cents was resumed to Government and kept in the custody of Gram Panchayat. The petitioners are complaining that without affording reasonable opportunity the assignment granted to petitioners or possession certificate granted in their favour is cancelled and also dispossess the petitioners from the subject matter of the writ petition. This Court is of the view that respondent No.4 ought to have given fair and reasonable opportunity before cancelling the allotment or resuming the land to Government. Without expressing further on the merits of the matter to meet the ends of justice, I am satisfied the writ petition can be disposed of by this order.

a. Petitioners are given four weeks time from today to file explanation or additional explanation to the notice, dated 14.09.2015.

b. Respondent No.4 is directed to consider the notice and also the explanation submitted by petitioners and pass orders as are deemed fit and proper in the circumstances of the case.

c. The parties are directed to maintain status quo vis-à-vis the subject matter of the writ petition for a period of three months from today.

d. Respondent No.4 is to dispose of the matter before expiry of three months period, during which, parties are directed to maintain status quo.

Both the writ petitions are disposed of as indicated above. 4.
