THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12008 of 2015 ORDER:

1. This Criminal Petition is filed by the petitioners-accused Nos.5 & 6 under Section 437 and 439 Cr.P.C seeking to grant bail to them in Crime No.343 of 2015-16 on the file of Prohibition & Excise Police Station, Narsipatnam, registered for the offence punishable under Sections 8( c) r/w 20(b)(ii)(c) of NDPS Act.

2. Heard and perused the material available on record.

3. It is alleged that the petitioners were found in possession of 135 kgs of Ganja.

4. Learned Counsel for the petitioners submitted that the petitioners did not commit any offence as alleged by the prosecution and they were falsely implicated in the above crime and that the petitioners were arrested on 10.7.2015 and since then, they have been in prison.

5. Since the ganja alleged to have been seized from the possession of the petitioners is commercial quantity, this Court is not inclined to grant bail to the petitioners.
