THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2379 OF 2014 ORDER:

This Criminal Revision Case is filed by the petitioners/A-1 to A3 under Sections 397 and 401 Cr.P.C. challenging the common order, dated 30.6.2014, in Crl.M.P.Nos.1309 and 1329 of 2014 in C.C.No.342 of 2012 on the file of the Judicial Magistrate of First Class, Badvel whereunder and whereby, two applications filed by the prosecution agency on behalf of the Station House Officer of B-Koduru Police i.e., one under Section 216 Cr.P.C. praying the Court to add the section of law under Section 354 I.P.C. by taking cognizance and the other under Section 323 Cr.P.C. praying the Court to order for committal of that case to the Court of Sessions for disposal, were allowed.

2. When the matter is posted for hearing, learned counsel for the petitioners informed this Court that C.C.No.342 of 2012 was already committed to the Court of Sessions and Sessions Case Number was also allotted.

3. Recording the same, this Court is of the view that this Criminal Revision Case has become infructuous.

4. Accordingly, this Criminal Revision Case is dismissed as infructuous. However, the petitioners are at liberty to file a discharge application before the Court concerned and if they are aggrieved by the order passed on the said discharge application, they can approach this Court.

5. Miscellaneous Petitions pending, if any, in this Criminal Revision Case shall stand closed.
