HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21387 OF 2016 ORDER:

The case of the petitioner is that the 5th respondent filed appeal No.D/871/2015 before the 3rd respondent-Revenue Divisional Officer questioning the order dated 02.04.2012 passed by the 2nd respondent-Tahasildar in File No.A/Spl./2012, wherein the 3rd respondent by order dated 21.11.2015 has set aside the order of the 2nd respondent and directed the 2nd respondent to conduct denova enquiry after giving opportunity to the parties; and that the 2nd respondent without conducting any enquiry as per the orders of the 3rd respondent has entered the name of the 5th respondent in the Revenue Records.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Since it is stated that the order passed by the 3rd respondent dated 21.11.2015 has become final, it is for the 2nd respondent to consider the case of the petitioner as well as the 5th respondent and pass orders.

In view of the same, the 2nd respondent is directed to pass orders in pursuance to the remand order dated 21.11.2015 passed by the 3rd respondent, after giving notice to all the affected parties and 5th respondent, within a period of six weeks from the date of receipt of a copy of this order and take action accordingly. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
