THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 19111 of 2016 ORDER :
Heard the learned counsel for the petitioner and the learned Government Pleader for Social Welfare. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.
2. There is no necessity to put the unofficial respondent on notice as this Court is not venturing to adjudicate the issue on merits.
3. The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in trying to dispossess the petitioner from land admeasuring Ac.5.00 cents in survey No.28/2 situated in Pidatamamidi Village, Gangavaram (Agency) Mandal, East Godavari District without following due process of law, as illegal, arbitrary and violative of principles of natural justice, and consequently direct the respondents not to dispossess the petitioner from the said land without following due process of law.
4. Though various grounds are raised in the Writ Petition, learned counsel for the petitioner restricted his prayer seeking a direction to the respondent authorities not to dispossess the petitioner from the said land except in accordance with law. The Government Pleader for
Social Welfare submits that he has no objection for the same.
5. Without going into the merits of the case and having regard to the facts and circumstances of the case, the Writ Petition is disposed of direction the respondent authorities not to dispossess the petitioner from the land in question except following due process of law. There shall be no order as to costs.
6. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
