THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10762 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/A3 seeking anticipatory bail in the event of his arrest in connection with Crime No.330 of 2023 on the file of Malakpet Police Station, Hyderabad, registered for the offence punishable under Section 8(c) r/w 20(b)(ii)(B) of NDPS Act, 1985.

Heard learned counsel for the petitioner/accused, learned Public Prosecutor representing the respondent-State and perused the record. 3.

Learned counsel for the petitioner submits that 4 kgs of dry ganja and two wheeler Honda Activa were recovered from A1 and A2. On the confession made by A1 and A2, the petitioner was impleaded as A3 and shown as absconded.

Learned Public Prosecutor submits that according to the investigation, the petitioner/A3 is the person who had supplied the said ganja to A1 and A2.

As seen from the record, apart from the said confession, no other evidence is produced. Keeping in view the same, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioner/A3 subject to the following conditions:

1) The petitioner/A3 is directed to surrender before the Station House Officer, Malakpet Police Station, Hyderabad, within a

period of seven days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A3 on bail, on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A3 shall appear before the concerned Station House Officer, every day, for a period of two(2) weeks between 10.00 A.M. and 1.00 P.M. and thereafter, as and when required for the purpose of investigation.

3) The petitioner/A3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
