THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44929 of 2016 ORDER:
This Writ Petition is filed by the petitioners under Article 226 of the Constitution of India seeking to declare the action of respondents 2 & 3 in not taking any action against the illegal construction taken up by the 4th respondent, as illegal, arbitrary, and unconstitutional and consequently direct respondents 2 & 3 to call for the records and stop and demolish the illegal construction on house bearing No.13-6-758/3, Om Shanti Nagar, Karwan Sahu, Hyderabad-500006.

Heard learned counsel for both the parties and perused the material available on record. With the consent of the learned counsel for both the parties, the writ petition is taken up for disposal at the stage of admission.

The case of the petitioners is that the petitioners, who are residents of Om Shanti Nagar, Karwan Sahu, Hyderabad, have given a written complaint to the respondent authorities on 21.10.2016 against the 4th respondent stating that the 4th respondent has illegally occupied the road land and trying to construct a house on the said land in the guise of a created sale deed and that on 23.11.2016, the 4th respondent illegally drilled borewell without getting any permission from the competent authorities. The main grievance of the petitioners is that the respondent authorities are neither passing any orders on the complaint said to have been submitted by the petitioners, dated
21.10.2016, nor taking any action against the 4th respondent for illegal construction.

When the matter is taken up for hearing, both the learned counsel agreed for disposal of the writ petition with a direction to the respondent authorities to expeditiously dispose of the complaint of the petitioners and take appropriate action, in accordance with law, if the constructions alleged to have been made by the 4th respondent is without permission/if there are any deviations in the permission already granted. 5.
Having regard to the same, without expressing any opinion on the merits of the matter, the Writ Petition is disposed of directing the respondent authorities to consider the complaint of the petitioners, dated 21.10.2016, and take appropriate action, in accordance with law, regarding the unauthorized constructions alleged to have been made by the 4th respondent. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
